Recently, the Colorado legislators passed a law, referred to as the ‘nexus’ tax which basically states that an online affiliate marketer doing online sales here will be required to collect a ‘sales tax’ and pay to the state.

Amazon, a very respected and highly trafficked site for product purchases, recently informed all of their affiliates located in Colorado that their relationship with them was over. No more Amazon affiliates in Colorado.

This law, the Affiliate Nexus Tax, AKA the “Amazon tax”, currently is in effect in four states; New York, North Carolina, Rhode Island and now Colorado, can have a tremendous effect on any affiliate. Yes Rhode Island is in the process of repelling the law but there are 13 other states currently looking into enacting this ‘nexus’ law and Virginia is very near approving one.

Has Amazon taken a stand for us small affiliates?

Amazon has an ongoing battle with the state of New York on the unconstitutionality of this law. The encroachment philosophy currently permeating throughout our federal and state governments could absolutely kill our way of life as we know it.

Colorado followed other states by increasing taxes, eliminating a long standing “physical presence” standard of residing and conducting business locally and replaced it with a nebulous, arbitrary standard of “economic presence” (physical vs. economic presence is large when it comes to nexus).

“Once you have nexus in a state, you then have to be set up to collect and
pay sales tax in that state. And CA is going even further in
claiming they have rights to tax your income as well.”

California wants to go further stating nexus will apply should you employ the services of any independent contractor (virtual assistant, lawyer, coach, consultant), a state that is almost bankrupt.

We are being told that the rich need to pay more of their fare share. What! The truth is shown in the chart below:
